1. Acceptance of Terms

By creating an account or using WhatsBulk ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may update these terms from time to time; continued use after changes constitutes acceptance.

2. Description of Service

WhatsBulk is a messaging platform that allows users to send bulk WhatsApp messages, manage contacts, create campaigns, and automate messaging workflows. The Service is provided on a subscription and credit-based model.

3. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must be at least 18 years old to use the Service.

4. Acceptable Use

You agree not to use the Service to:

  • Send spam, unsolicited messages, or messages to recipients who have not opted in.
  • Violate WhatsApp's Terms of Service or any applicable law or regulation.
  • Harass, threaten, defame, or send abusive content to any person.
  • Transmit malware, phishing links, or any malicious content.
  • Impersonate another person or entity.
  • Send messages promoting illegal goods, services, or activities.
  • Circumvent any rate limits, security measures, or access controls.

Violation of these rules may result in immediate account suspension or termination without refund.

5. Subscriptions and Credits

The Service offers subscription plans with monthly credit allocations. Credits are consumed per successfully delivered message. Unused credits do not roll over to the next billing period unless stated otherwise. Subscription fees are billed monthly in advance and are non-refundable. You may upgrade or downgrade your plan at any time; changes take effect at the start of the next billing cycle.

6. Payments

Payments are processed through Paystack, a third-party payment processor. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis. You are responsible for keeping your payment information up to date. Failed payments may result in service suspension.

7. WhatsApp Compliance

WhatsBulk is an independent platform and is not affiliated with, endorsed by, or sponsored by WhatsApp or Meta. You are solely responsible for complying with WhatsApp's Terms of Service and policies. WhatsBulk is not responsible for any actions taken by WhatsApp against your account, including number bans or restrictions.

8. Number Safety

While WhatsBulk provides tools such as rate limiting, time gaps, and batch sending to help protect your WhatsApp number, we cannot guarantee that your number will not be banned or restricted by WhatsApp. You use the Service at your own risk and are responsible for following best practices to maintain your number's health.

9. Data Ownership

You retain ownership of all content you upload or send through the Service, including contacts, messages, and templates. We do not claim ownership over your data. You may export your data at any time through the dashboard.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our control. We are not liable for any losses resulting from service interruptions.

11. Limitation of Liability

To the maximum extent permitted by law, WhatsBulk and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

12. Termination

We may suspend or terminate your account at any time for violation of these terms. You may cancel your account at any time through the dashboard. Upon termination, your data will be retained for 90 days before permanent deletion.
