Terms of Service

1. Acceptance of Terms
By creating an account or using WhatsBulk ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may update these terms from time to time; continued use after changes constitutes acceptance.
2. Description of Service
WhatsBulk is a messaging platform that allows users to send bulk WhatsApp messages, manage contacts, create campaigns, and automate messaging workflows. The Service is provided on a subscription and credit-based model.
The Service supports two integration paths: (a) a personal WhatsApp pairing flow that connects to your existing WhatsApp account via a scanned QR code, and (b) the official WhatsApp Business Cloud API, in which you connect a WhatsApp Business Account (WABA) through Meta's Embedded Signup and we route outbound messages through Meta's infrastructure on your behalf as a Meta Tech Provider.
3. Account Registration
You must provide accurate, complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must be at least 18 years old to use the Service.
4. Acceptable Use
You agree not to use the Service to:
- Send spam, unsolicited messages, or messages to recipients who have not opted in.
- Violate WhatsApp's Terms of Service, the WhatsApp Business Messaging Policy, the WhatsApp Commerce Policy, or any applicable law or regulation.
- For WhatsApp Cloud API usage: send marketing, utility, or authentication messages without using a Meta-approved message template when required, send messages outside the 24-hour customer service window without a template, or fail to honor opt-out requests (STOP, UNSUBSCRIBE, etc.) within a reasonable time.
- Harass, threaten, defame, or send abusive content to any person.
- Transmit malware, phishing links, or any malicious content.
- Impersonate another person or entity.
- Send messages promoting illegal goods, services, or activities.
- Circumvent any rate limits, security measures, or access controls, including Meta's WABA messaging tier limits and quality-rating system.
Violation of these rules may result in immediate account suspension or termination without refund. For WhatsApp Cloud API usage, repeated policy violations may also result in Meta lowering your WABA quality rating, restricting your messaging tier, or suspending your WABA entirely — actions which we cannot reverse and which may affect message delivery independently of your subscription with us.
5. Subscriptions and Credits
The Service offers subscription plans with monthly credit allocations. Credits are consumed per successfully delivered message. Unused credits do not roll over to the next billing period unless stated otherwise. Subscription fees are billed monthly in advance and are non-refundable. You may upgrade or downgrade your plan at any time; changes take effect at the start of the next billing cycle.
6. Payments
Payments are processed through Flutterwave, a third-party payment processor. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis. You are responsible for keeping your payment information up to date. Failed payments may result in service suspension.
7. WhatsApp Compliance & Tech Provider Role
WhatsBulk is a Meta-approved Tech Provider for the WhatsApp Business Cloud API. We provide software that connects your business to Meta's messaging infrastructure; we are not WhatsApp or Meta and are not endorsed by them beyond the Tech Provider designation.
You are the business of record for all messages sent from a WhatsApp Business Account you connect. You are solely responsible for complying with WhatsApp's Terms of Service, the WhatsApp Business Messaging Policy, the WhatsApp Commerce Policy, and any applicable telecommunications, consumer-protection, and data-protection laws in the jurisdictions you message into. WhatsBulk is not responsible for actions taken by WhatsApp or Meta against your account, including number bans, quality-rating downgrades, messaging-tier restrictions, or WABA suspensions.
8. Number Safety
For the personal WhatsApp pairing flow, WhatsBulk provides tools such as rate limiting, time gaps, and batch sending to help protect your number, but we cannot guarantee that your number will not be banned or restricted by WhatsApp. You use that integration at your own risk.
For the WhatsApp Business Cloud API, your number operates under Meta's official policies. Meta independently assigns and adjusts a quality rating (GREEN / YELLOW / RED) and a messaging tier (250 / 1K / 10K / 100K / unlimited 24-hour conversations) based on recipient feedback, block rates, and policy compliance. We surface these values in your dashboard, but we do not control them. Following messaging best practices — clean opt-in, respecting opt-outs, accurate templates — is the only reliable way to maintain a healthy number.
9. Data Ownership & WABA Ownership
You retain ownership of all content you upload or send through the Service, including contacts, messages, and templates. We do not claim ownership over your data. You may export your data at any time through the dashboard.
If you connect a WhatsApp Business Account through Embedded Signup, that WABA is owned by you under your own Meta Business Portfolio. We hold operational access (a system-user access token) only for the purpose of sending and receiving messages on your behalf. You may disconnect the WABA from our platform at any time through your Meta Business settings or by contacting us; doing so revokes our access without affecting your WABA itself, which remains yours.
10. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our control. We are not liable for any losses resulting from service interruptions.
11. Limitation of Liability
To the maximum extent permitted by law, WhatsBulk and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.
12. Termination
We may suspend or terminate your account at any time for violation of these terms. You may cancel your subscription at any time through the dashboard, or permanently delete your account and all associated data immediately via Settings → Danger Zone. Account deletion is irreversible and removes campaigns, contacts, automations, templates, message logs, connected WhatsApp numbers, subscriptions, and credits.
If you have a WhatsApp Business Account connected via Embedded Signup, terminating or deleting your account on WhatsBulk revokes our access token and stops further messages routed through us. Your WABA, phone number, and Meta Business Portfolio remain yours and are unaffected; you retain ability to onboard them to another Tech Provider or to use them directly via Meta's Cloud API.
